ELLIS ESQ TERMS & CONDITIONS
Use of the ellisesq.com website, any affiliated payment links, point-of-sale systems, or services provided by Ellis ESQ, LLC constitutes acceptance of these Terms and Conditions (“Terms”). Please review these Terms carefully before engaging with us.

These Terms and Conditions represent the full agreement between Ellis ESQ, LLC (“Ellis ESQ,” “we,” “us,” or “our”) and the customer (“you,” “client,” or “buyer”) relating to any purchase, service, or transaction with Ellis ESQ. They cannot be varied unless approved in writing by a Director or Owner of Ellis ESQ.
If any part of these Terms is deemed unenforceable under state or federal law, the remaining provisions shall continue in full force and effect.
1. AGE REQUIREMENT
You must be 18 years of age or older to make a purchase through any Ellis ESQ channel. By making a purchase, you confirm that you meet this requirement. Ellis ESQ does not sell products or services to minors and does not knowingly collect personal data from anyone under 13 years of age.
2. ACCOUNT SECURITY
Certain website features may require you to create an account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.
You agree to notify Ellis ESQ immediately of any unauthorized use or breach of security. Ellis ESQ is not liable for any losses resulting from your failure to secure your account. We reserve the right to suspend or terminate account access at our discretion.
3. RESALE OR THIRD-PARTY SUPPLY
All goods and services provided by Ellis ESQ are intended for personal use unless explicitly authorized for resale in writing. Ellis ESQ reserves the right to refuse supply to any person or entity at its sole discretion.
4. ORDER MODIFICATIONS
Requests to modify an order or measurement profile must be submitted to info@ellisesq.com as soon as possible. Modifications can only be made if production has not yet begun. Once production starts, no changes can be guaranteed or accepted.
5. GENERAL PURCHASE TERMS
Orders placed through ellisesq.com or any Ellis ESQ system are for personal use only. Unauthorized resale, reproduction, or distribution of Ellis ESQ products is strictly prohibited.
Ellis ESQ reserves the right to cancel or refuse any order at its sole discretion, without liability.
6. PRODUCT AVAILABILITY
All product and fabric offers are subject to availability. We strive to keep our listings accurate but may update or withdraw items without notice. In rare cases of simultaneous orders or material shortages, you will be notified of any extended delay and may choose to wait or cancel for a full refund.
7. VISUAL ACCURACY
While Ellis ESQ aims to represent all colors, textures, and designs accurately, variations may occur due to display settings, lighting, or screen calibration. Ellis ESQ is not responsible for such discrepancies.
8. PAYMENT POLICY
All online orders must be paid in full at checkout. In-person or virtual custom orders require a 50% deposit to begin production, with the remaining balance due no later than three (3) weeks after deposit.
Late balances are subject to a 5% daily penalty of the total order value.
We accept Visa, MasterCard, American Express, PayPal, Discover, and authorized gift cards.
All transactions are processed in USD unless otherwise stated. Sales tax is applied based on jurisdictional requirements.
9. PAYMENT SECURITY
All payments are securely processed by trusted third-party providers. Ellis ESQ does not store full credit card information. We do not request payment information by phone or email. If bank or payment details change, written confirmation from an official Ellis ESQ representative is required before remittance.
10. CUSTOM & BESPOKE ORDERS
Custom and bespoke garments are made-to-order based on approved designs and measurements. Production begins only after deposit payment is confirmed.
Due to the personalized nature of these garments, all custom and bespoke sales are final. Refunds or exchanges are not available unless expressly approved in writing and determined to result from an Ellis ESQ error.
11. SHIPPING & DELIVERY
Ellis ESQ aims to deliver all standard orders within six (8) weeks from receipt of deposit. Rush or express services may be available upon request for an additional fee.
Shipping costs vary by region; domestic U.S. and Canadian standard shipping is complimentary. International orders may incur taxes, duties, or import fees payable by the recipient.
12. SHIPPING DELAYS, COURIER ISSUES & FORCE MAJEURE
While Ellis ESQ endeavors to meet all estimated timelines, delivery dates are approximate and not guaranteed.
Ellis ESQ is not liable for delays, damages, or loss arising from circumstances beyond our control, including but not limited to:
- Courier or carrier delays (e.g., USPS, UPS, FedEx, DHL)
- Customs or import inspections
- Weather conditions, natural disasters, or pandemics
- Labor strikes, transportation disruptions, or acts of God
- Supplier or manufacturing delays outside our direct control
In such cases, Ellis ESQ will make reasonable efforts to ensure timely delivery but shall not issue refunds, credits, or chargeback approvals for delayed packages or shipments once handed to the carrier.
Title and risk transfer to the customer once the order leaves our facility. Any claims for shipping damage or loss must be filed directly with the carrier, though Ellis ESQ will assist in facilitating such claims where possible.
Delays caused by shipping carriers or external conditions shall not be considered non-performance or grounds for refund, cancellation, or chargeback.
13. DELIVERY PROBLEMS
If your delivery is delayed beyond the estimated timeframe, contact our customer care team. While we will assist in locating your package, Ellis ESQ’s responsibility ends upon verified shipment.
A signature from an adult (18+) may be required for delivery.
14. RETURNS, ALTERATIONS, & WARRANTY POLICY
a. Returns & Exchanges
All custom and bespoke garments are final sale. Refunds or remakes are only offered if Ellis ESQ determines a manufacturing defect or measurement error was made by our team.
Fit & Production Errors
ELLIS ESQ. guarantees that all garments will be produced according to the client’s confirmed measurements, confirmed &.outlined design selections, and approved specifications. In the event that a verified production or workmanship error is determined to be on the part of ELLIS ESQ., the company will, at its discretion, correct the garment, remake it, or issue a store credit.
A “production error” is defined as an objective deviation from the client’s approved measurements or design specifications. Subjective fit preferences, including comfort adjustments or changes in client body measurements after the initial fitting, are not considered production errors and are therefore not eligible for complimentary remakes or alterations.
b. Alteration Credit
Clients receive one (1) alteration credit per order, up to 5% of the purchase price, for alterations performed by a qualified tailor within seven (7) days of receipt. Submit your alteration receipt to info@ellisesq.com within 30 days to receive reimbursement or credit.
c. Warranty
Each garment is warranted to be free of manufacturing defects at delivery. Ellis ESQ disclaims all other warranties, including implied warranties of merchantability or fitness for a specific purpose.
15. PRIVACY POLICY
Ellis ESQ collects personal information to process orders, improve service, and communicate with clients. We do not sell or rent personal data. Data may be shared only with trusted partners bound by confidentiality agreements.
By engaging with us, you consent to our use of cookies, analytics, and communications for transactional or marketing purposes. You may opt out of promotional emails at any time.
Ellis ESQ complies with all applicable privacy laws in the U.S. and Canada.
16. GOVERNING LAW
These Terms and all transactions with Ellis ESQ shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the competent courts of Durham County, North Carolina, unless otherwise required by law.
17. AGREEMENT ACKNOWLEDGEMENT
By submitting payment, signing a contract, or placing an order through any Ellis ESQ channel, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
