Ellis ESQ Terms and Conditions

WHEREAS, Ellis ESQ (hereafter referred to as “the Company”) specializes in the production of custom and bespoke suits, and any individual (hereafter referred to as “the Client”) who places an order agrees to the following terms and conditions:


1. SCOPE OF SERVICES

1.1 Custom Suit Specifications:
The Company agrees to produce a custom suit for the Client according to the following specifications:

  • Fabric Choice: [Insert Fabric Name/Code]

  • Design Features: [Insert Design Elements]

  • Measurements: [Attach or reference detailed measurements]

1.2 Order Confirmation:
Production begins only after the following are received:

  • A signed copy of this agreement

  • Payment as outlined in Section 4


2. CLIENT RESPONSIBILITIES

2.1 Measurement Accuracy:

  • Measurements taken by the Company or authorized representatives are guaranteed.

  • If measurements are self-submitted or provided by a third party, the Client assumes full responsibility for accuracy.

2.2 Fabric and Design Approval:

  • Clients must approve all fabric and design choices before order confirmation.

  • Any post-approval changes may incur additional costs and are subject to availability.


3. PRODUCTION TIMELINE

3.1 Estimated Delivery:
Standard production time is [4–8 weeks], beginning upon order confirmation and receipt of deposit.

3.2 Delays:

  • The Company will inform the Client of any delays due to fabric backorders, supply chain issues, or other unforeseeable events.

  • The Company is not liable for delays outside its control, including but not limited to natural disasters or shipping disruptions.

3.3 Rush Orders:
Expedited orders may be available for an additional fee, subject to fabric and production availability.


4. PAYMENT TERMS

4.1 Payment Structure:

  • A non-refundable 50% deposit is required to initiate production.

  • The remaining balance must be paid prior to delivery or shipment.

4.2 Accepted Methods:

  • The Company accepts credit card, bank transfer, PayPal, or Stripe.

4.3 Non-Payment:

  • Production will not begin until the deposit is received.

  • Final payment must be received in full before release or shipping of the product.


5. RETURNS AND REFUNDS

5.1 Custom Product Policy:
All custom orders are non-returnable and non-refundable, except in cases of material defects or errors attributable to the Company.

5.2 Fit Adjustments:

  • Minor alterations are covered if reported within 30 days of delivery.

  • Alteration reimbursements for local tailoring are capped at [$XX], pending prior approval.

5.3 Remakes:
Remakes are only available if errors are due to Company fault in measurement or material.


6. LIABILITY AND DISCLAIMERS

6.1 Color Variation:
Minor differences in color, texture, or appearance due to screen settings or fabric dye processes are considered normal and do not qualify as defects.

6.2 Limitation of Liability:
The Company’s liability is strictly limited to the cost of the suit ordered.


7. PRIVACY, MARKETING, AND DATA CONSENT

7.1 Use of Client Information:

  • Personal data, including measurements and contact details, will only be used to process and fulfill the Client’s order.

  • All information is stored securely and confidentially.

7.2 SMS and Email Marketing Consent:

  • By placing an order, the Client agrees to opt-in to receive transactional and promotional emails and SMS messages from the Company.

  • These communications may include order updates, promotional offers, event invitations, and brand updates.

  • Clients may unsubscribe or opt-out at any time via the unsubscribe link or by replying STOP to SMS communications.


8. GOVERNING LAW AND DISPUTES

8.1 Jurisdiction:
This Agreement is governed by the laws of [Insert State or Jurisdiction].

8.2 Dispute Resolution:
Disputes will be resolved first through good-faith negotiation. If unresolved, they will be submitted to binding arbitration in [Insert Location].


9. ENTIRE AGREEMENT

9.1 Full Understanding:
This document represents the entire agreement between the Client and the Company and supersedes all prior discussions or agreements.
