Use of the ellisesq.com website – a division of the company Ellis ESQ, LLC , any of its services, or point of sale systems implies acceptance of these Terms and Conditions. To protect your own interests please read our Terms and Conditions carefully before accepting them. If you are uncertain as to your rights or want any explanation about our Terms and Conditions, please email firstname.lastname@example.org. We invite you to print these Terms and Conditions or we can email them to you upon request. These Terms and Conditions contain the whole of our agreement relating to your purchase including information about our pricing and contact details. They cannot be varied unless an approval to do so is signed by the Owners or Director of the company Ellis ESQ, LLC (a limited liability company)/www.ellisesq.com. If any part of these Terms and Conditions are declared void for unfairness pursuant to state and federal laws, the remaining contract shall continue to bind the parties excluding the specific unfair terms exception(s).
You must be 18 years of age or older to make a purchase on the ellisesq.com website or any point of sale system that the company uses. By making a purchase, you represent that you are at least 18 years old. We do not sell products directly nor service for purchase by children. The website is not direct to nor do we knowingly collect personally identifiable information from children, including those under the age 13.
Certain features or services offered on the ellisesq.com website may require you to open account. You are entirely responsible for maintaining the confidential information for your account, including passwords and for any and all activity that occurs under your account as a result of you failing to keep this information secure. You agree to notify Ellis ESQ of any unauthorized use of your account or password or any other breach or security. You may be held liable for all losses incurred by ELLIS ESQ or any other visitor to the website due to someone else using your account information. Access to your account may be terminated or suspended in our sole discretion.
RESALE OR THIRD-PARTY SUPPLY
Even without a prior written agreement all goods supplied are for personal use and are offered also for re-sale. We reserve the right to refuse to supply any person or company. If you are interested in re-selling our products in larger scale, please contact us in advance in order to become an approved affiliate.
In case you want to change your order details or your measurement profile for order you have already placed, please contact our customer service representatives as soon as possible at email@example.com We are able to amend the product(s) you ordered only if production has not begun. Therefore, we cannot guarantee the acceptance of your request for modification.
PURCHASE GENERAL TERMS
Orders may only be placed on the ellisesq.com website for personal use and not for resale. Any resale or distribution of Ellis ESQ products purchased on the ellisesq.com website is strictly prohibited without prior authorization.
RIGHT TO CANCEL
Ellis ESQ reserves the right to cancel any order placed by a customer in its sole discretion and without liability, including without limitation.
All offers of products as they appear on the Ellis ESQ website are subject to availability. Ellis ESQ reserves the right to change the items proposed on the Ellis ESQ website at any time and without notice. We attempt to provide information about the availability of the time of product at the time of the order. At times errors may happen including when simultaneous orders of the same product are being placed by several customers. If a product is not available without a material delay after you place your order, you will be informed by email. You may then wait until the product becomes available or cancel and any amount will be refunded.
While we take steps to ensure that the coloring, design and style of the Ellis ESQ products in each photograph or any other representation displayed on the Ellis ESQ website or multimedia platforms are represented of the origin product, variation may occur due to technical restrictions of the color reproduction on your computer or equipment. Ellis ESQ will not be liable for any error or inaccuracy in the photographs or other representations of Ellis ESQ products displayed on our website.
The data collected by the Ellis ESQ website establishes the terms of transactions between Ellis ESQ and its customers. In the event of dispute between Ellis ESQ and its customers relating to transactions entered in the Ellis ESQ website and subject to Ellis ESQ right to cancel or not accept an order, the date collected by Ellis ESQ are the terms of the transaction.
Ellis ESQ takes many active steps to ensure the absolute safety of your credit card and personal information. We process all credit card sales via a fully secured and reputable third-party payment processor and we do NOT keep full credit card information on record.
WHAT PAYMENT METHODS DO YOU ACCEPT?
We accept Visa, MasterCard, American Express, PayPal, and authorized Ellis ESQ Gift Cards.
WHAT CURRENCY IS USED FOR TRANSACTION?
All transactions on ellisesq.com or any point of sale system that we use is in US dollars.
WILL THERE BE SALES TAX ON MY ORDER?
If you live in North Carolina, you will be charged applicable sales tax. If you live in Canada, you may be charged provincially applicable PST/HST/GST depending on our business operations at the time of purchase. The areas where we collect sales tax are subject to change depending upon state and federal laws.
Depending on your order a security deposit may be required. This minimal payment is used to secure different aspects of your order including the date your custom or bespoke piece is needed, any promotional rates discussed during your initial consultation and all Ellis ESQ Services including , styling, designing, creation, shipping all communication etc.
Both the retainer & security deposits are non refundable, due to work that has already been procured by our designer and team.
DO YOU HAVE GIFT CARDS?
Yes. Ask about the availability of these.
HOW DO I USE MY GIFT CARD?
Enter the unique code on the back of your card e-gift card at checkout. Gift cards operate like cash. Protect your code. Once the code has been used, it cannot be used again.
CAN I USE TWO COUPONS AT ONCE?
No, you can’t use two coupons at once; however, you can use gift cards and coupons together.
All online orders must be paid in full at the time of purchase. All payments are processed online. We do not accept total payments on delivery. The price for the products shall be the price agreed upon between the parties. Typographic or other errors in stated prices are subject to correction and ELLIS ESQ reserves the right to not honor any sales made for items with incorrect pricing. If such transactions occur, the customer will be refunded the amount paid for the purchase and any sales tax.
CREDIT AND TERMS OR PAYMENT
Buyer is solely responsible for ensuring that payment is made to Seller’s correct location. For fraud avoidance purposes, Seller will never initiate payment method changes via email or telephone. In the event Seller needs to change its payee bank account information or payment method, then Seller will send Buyer a notification letter. Upon receipt of such letter and prior to changing bank account information or payment method, Buyer must contact Seller’s representative to positively confirm the account change. At all times Buyer is responsible for ensuring that payment is made to Seller’s correct location and Buyer accepts this responsibility. Payments are only accepted by major credit cards including VISA, MASTERCARD, AMEX, DISCOVER, PayPal & some US debit cards. Payment methods are subject to change.
CUSTOM & BESPOKE (PAYMENTS)
Custom & Bespoke orders made while working face to face with a Style Esquire / Master Clothier requires a 50% deposit on order. The remaining balance is due no later than three weeks after the initial order. Late payments will be subject to a 10% penalty of the entire purchase price per day.
SHIPPING AND DELIVERY
Ellis ESQ orders are delivered within a 6 week window. We strive to deliver orders as soon as possible.
Any delivery failure or late delivery that exceeds the days specified can be reported to our customer care department. Ellis ESQ is exempt from all responsibility unless by cause of Ellis ESQ. Our team will help where possible in the resolving or locating your package.
A signature of an adult aged 18 or older may be required for delivery. Customer assumes all responsibilities for this process.
SHIPPING COSTS, EXPRESS SHIPPING, AND RUSH ORDERS
As a part of your order process, you may be asked to select the shipping method that you prefer. The default option is standard shipping. Cost for delivery to the US or Canada with standard shipping will be free as courtesy of Ellis ESQ. For addresses outside of the US or Canada, all required taxes, VAT, import or excise duties are the sole responsibility of the recipient in their specific country.
Express shipping and rush orders may be available in some cases. These charges will be passed to the customer. Please email us if you require these services. Pre-payment of the extra shipping or rush charges must be paid prior to shipping. We will do our best to meet your timelines; however, as these are custom creations, the rush order cannot be guaranteed outside of our standard 6 to 8 week turn-around time. Refunds of any part of the extra charge or sales tax where applicable will be not be honored. For events and occasions, please be sure to place your order 8-10 weeks in advance, as delivery timelines may fluctuate throughout the year.
RETURNS, EXCHANGES, ALTERATIONS, AND WARRANTIES
It is our mission for you to be completely satisfied with every purchase from ELLIS ESQ and we want you to be totally happy with your garments and our service.
Upon arrival of your package, please inspect your garments carefully and report any damages to the firstname.lastname@example.org within five business days. While we offer only the finest fabrics in the world, to ensure the highest quality garments possible, we cannot be held liable for damages caused by personal wear. Additionally, we recommend that you purchase an extra pair of trousers for each suit purchase to increase longevity.
As we offer customized products that are unique to you, outside of errors of fit on our part due to items not coinciding with measurements provided, Ellis ESQ does not provide refunds or exchanges on custom garments.
If you are submitting measurements yourself, please verify the measurements prior to submitting your order. If your personal measurements or style requests do not match with your original submitted order, we will have the garment re-altered by one of our tailors at no charge to you. If the garment is deemed unalterable we will remake your garment at no charge to you if error is on our end, otherwise, the garment will be reconstructed with a 30% discount. You will not be able to change the style or fabric of the garment if it needs to be reconstructed. If the material is no longer in stock we will offer similar materials to re-construct the garment.
Sometimes your custom garment may require an extra bit of attention for your perfect fit. We understand that personal preference is a great component of style. While we cannot offer refunds, one time alteration credits of up to $60 dollars are available within 30 calendar days of shipping of your garment and can only be processed with a receipt from your local tailor. If your custom garment requires further alterations, please follow these instructions:
1) print out a copy of your measurements and take them to your local tailor.
2) have the tailor to correct your measurements on the form according to your desired style.
3) update your measurements in your profile
4) send a copy of the receipt to email@example.com
Ellis ESQ collects information from you when you create an Ellis ESQ account or update your account, when you book an appointment or fitting with us, shop online or in our showrooms, opt-in to receive our newsletters, participate in giveaways, sweepstakes, contests, promotion or survey, or join our social networking sites. When you create an Ellis ESQ account, we may ask for information such as your name, phone number, email address, city, state and zip code.
Once you create and sign into your account, Ellis ESQ automatically receives information from your browser, such as your IP address, and cookies. Cookies enable our website to recognize you as you move throughout our website and stores your navigational patterns and any items you have placed in your shopping cart. Your web browser also allows us to track statistics such as types of browsers on our website, page views, navigational patterns and high traffic areas. This information does NOT track personally identifiable information about our users.
We may combine your information from our website with information you have provided in our showrooms to ensure that our service to you is relevant and timely.
We limit access to personal information about you to employees who we believe reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs. We have physical, electronic and procedural safeguards that comply with federal regulations to protect personal information about you.
Ellis ESQ does not rent, sell or share your personal information to unaffiliated third parties. Occasionally, we work with trusted partners who work on our behalf to improve our services to you. These partners may have access to your personal information after they have agreed to our confidentiality agreement.
In addition to using your personal information to improve and enhance your experience with Ellis ESQ, we use information to better target our marketing to your behavioral preferences. If you create an account on our website, you will be required to provide your email address and you may automatically be added to our email list and receive marketing or promotional information from us.
If you do not wish to receive Ellis ESQ marketing emails, you may opt out by clicking on the unsubscribe link found at the bottom of all Ellis ESQ marketing emails. Please be aware that it can take up to 10 business days to remove you from our marketing email lists.
Please note that if even if you unsubscribe to our marketing email list, you will still receive servicing emails such as notifications of upcoming appointments, order confirmation and shipment status.
